
ERG-21 – Land
Related Issues
This project focuses on ongoing issues in the general area of Land
Pollution Control. The initial project dealt with the legislative and
regulatory programs of Illinois’ TACO – tiered approach to
corrective action. The project also involved development of
proportionate share liability implementing regulations. Issues such as
rewriting TACO regulations and relations with the Office of Chemical
Safety are incorporated into this project as they arise.

ERG-25 - Pollution Prevention
This project involves providing input and advice regarding the
State's various pollution prevention programs existing
within the State (IEPA, HWRIC and DCCA).

ERG-27 - Clean Air Act Implementation
This project focuses on ongoing issues in the general area of Air
Pollution Control related to the development of legislation and
regulations specific to compliance with the Clean Air Act. The
project has been broken into subparts due to the complexity of the
issues involved. Initial work involved the development of the CAA
statute for Illinois (Section 39.5), and associated regulations and permitting
forms. Ongoing involvement include promoting measure to (1) streamline the CAA
permitting program; (2) modify the existing federal CAA permitting
program; (3) develop and implement enhanced monitoring rules; (4)
change the national ambient air quality standard; (5) modify the
definitions of various pollutants (e.g., volatile organic
materials). Pertinent
issues are incorporated into this project as they arise.

ERG-35 - Ozone Attainment Issues
This Air Pollution related project was initiated to assist the IEPA
in the development of the Emission Reduction Market System (ERMS)
legislation and regulations. The project continues to monitor
progress and events in this area. Most recently work dealing with
the reporting of Hazardous Air Pollutants is underway. The project
is further involved in the activities of the Ozone Transport
Assessment Group and the IEPA in their assessment of the ozone
transport issue. This led to active involvement in the regulatory
proceedings attendant to the ozone SIP call and long range
transport.

ERG-36 - Water Related
Issues
Monitoring of the IEPA's Triennial Review Process to identify and
address problems or potential problems facing the regulated
community was the genesis of this project. It rapidly became evident
that the IEPA and USEPA were accelerating activities in water
pollution related issues. The project has and will continue to be
active in the regulatory processes related to antidegradation and TMDL
issues. Pertinent issues such bio-criteria development, regulated
recharge area establishment and Lake Michigan initiatives are
incorporated into this project as they arise.

ERG-37 - PM2.5
The Work Group formed to participate in development of the
PM2.5 NAAQS implementing
regulations.

ERG-39 – EPCRA Related Issues
This newly created Work Group was formed to participate in issues
related to compliance with the Emergency Planning and Community
Right to Know Act. This Act, administered in Illinois by the
Illinois Emergency Management Agency, affects all members. The IEMA
asked for input in its efforts to upgrade and increase the
activities of the Local Emergency Planning Committees. This request
was the genesis of the project.

ERG-40 Isolated Waters
This newly created Work Group was formed to
participate in issues related to isolated waters and Section 404 of
the Clean Water Act. In January 2001, the United States Supreme Court
held that isolated, non-navigable, intrastate waters, which would
include isolated wetlands, were not under the jurisdiction of the Corp
of Engineers; therefore, “dredge and fill” projects involving such
waters did not require permits. Since the creation of this
"gap" by the Court’s decision, various environmental
groups, local government entities, and state legislators have
attempted to fill this "gap" by proposing state legislation,
including most recently by Representative Karen May in the Spring 2002
legislative session. Concerns with the legislation led various
business and industry associations to ask IERG to coordinate an effort
to prepare an effective, acceptable alternative to the existing
legislation for proposal in the General Assembly.

ERG-41 Air Related Issues
This project was formed in an effort to centralize
all of the work that had previously been done in
three separate Work Groups. Beginning on April 21, 2004,
all of the work being done in ERG 27, which focused on on Section
39.5 of the Illinois Environmental Protection Act,
permit streamlining, and national ambient air
quality standards; ERG 35, which focused on the Emission
Reduction Market System legislation and regulations, the reporting
of Hazardous Air Pollutants, and the assessment of
ozone transport; and ERG 37, which focused on
the development of the PM2.5 NAAQS implementing regulations;
will fall under this new Work Group and Project Memorandum, now
entitled Air-Related Activities.

ERG-42 Climate Change & Sustainability-Related
Issues
This
project focuses on ongoing and upcoming issues regarding climate
change policy, and industry’s response to public demand for
determining facilities “carbon efficiency” and “carbon
footprint.” The purpose of the project is to collect and relay
information regarding these matters for the Members’ consideration
and review in making management decisions affecting their operations.
The project will further serve to allow companies to exchange
information regarding “sustainability” programs to avoid
duplicative efforts or implementing failed programs.
Topics addressed will
include carbon controls: greenhouse gas (“GHG”) emissions
reporting, cap and trade program, carbon tax, renewable energy
portfolio standards, etc. Also addressed will be sustainability
related issues: greening the supply chain and supplier
protocols, other “green” protocols – such as green chemistry and
green transportation, and programs such as plastic bottle bans and
mandatory recycling, etc. Further, this project monitors and
communicates activities of initiatives associated with GHG matters,
such as those by USEPA and Illinois EPA and voluntary reporting
systems.

Environmental Fees/Permit Streamlining
This project focuses solely on the multitude of legislative
initiatives before the current General Assembly which either raise new
environmental fees or increase existing ones. At various times during
this legislative session, the regulated community has been asked to
pay over $25 million in new NPDES fees, $9 million in increased CAAPP
fees, $2 million in new construction permit fees, and untold millions
in other fees, such as asbestos notification, fleet registration, and
many others. Pertinent issues are incorporated into this project as
new developments before the General Assembly or as regards to
Illinois' budget arise.
